Z uporabo te spletne strani se obiskovalec oziroma potrošnik strinja s splošnimi pogoji poslovanja. Obiskovalec ki bo vnesel kakršnekoli podatke je obvezan vnašati samo točne in resnične podatke, informacije, gradiva, itd.. Netočne in neresnične podatke bomo obravnavali kot zlorabo, in jo predali ustrezni pravni službi. Podatke pridobljene preko spletnih obrazcov in pri naročanju, bomo uporabili le v namene poslovanja podjetja PAKETKO d.o.o.. Terms and conditions v nadaljevanju obravnavajo delovanje spletne trgovine termoplast.si pravice uporabnika ter poslovni odnos med ponudnikom in kupcem.
Communication and notifications:
The provider will contact the user via means of distance communication only if the user does not expressly object. Promotional electronic messages will contain the following elements:
- they will be clearly and unambiguously marked as promotional messages
- the sender will be clearly identifiable
- various campaigns, promotions and other marketing techniques will be marked as such
- the way to unsubscribe from promotional messages will be clearly presented
- the provider will expressly respect the user's wish not to receive promotional messages
Orders:
Željeno blago naročite elektronsko preko spletnega kataloga oz. naročilnice, preko e-poštnega naslova: info@termoplast.si ali preko telefona na podlagi cenika. Podatki o sklenjeni pogodbi oziroma o oddanem naročilu so shranjeni pri podjetju PAKETKO d.o.o. Pogodba se lahko sklene v slovenskem jeziku. Pogodbo oziroma naročilo lahko sklenete po telefonu, elektronski pošti ali internetu preko spletne trgovine. Popravke ali dodatke k naročilu nam lahko pošljete po elektronski pošti ali telefonu v roku dveh ur od oddaje naročila.
Registriranje uporabnika - kupca:
Za nakup v spletni trgovini termoplast.si registracija uporabnika ni nujno potrebna, je pa zaželena. Ob registraciji na termoplast.si obiskovalec pridobi uporabniško ime ter geslo. Uporabniško ime in geslo uporabnika nedvoumno določata in povezujeta z vnesenimi podatki. Z registracijo obiskovalec postane registrirani uporabnik portala termoplast.si in pridobi pravico nakupa v spletni trgovini termoplast.si. Ob registraciji preko spletne strani termoplast.si, ali preko socialnega omrežja Facebook, ter ob vsakem oddanem naročilu se strinjate s prejemanjem promocijskih obvestil preko e-maila, na katera se lahko tudi odjavite in ponovno prijavite.
Purchase process:
1. Order confirmation: when placing an order (cart), a review of the entire order is available before the order is submitted. You can change the quantity of the desired items, and you can also add or remove items.
2. Order submission: after submitting the order, the consumer receives an email confirmation that the order has been accepted. The message contains a summary of the order and all the information the buyer needs about the further course of the purchase. The message serves as an informative proforma invoice. At this step the consumer has the option to cancel the order within one hour.
3. Order confirmed: if the consumer does not cancel the order, it proceeds to further processing. When the provider reviews the order, it checks the availability of the ordered items and either confirms the order or refuses it with a reason. To verify data or ensure accurate delivery, the provider may call the buyer on their contact telephone number or contact them by email. On confirming the order, the provider informs the buyer of the estimated delivery time. At this stage the contract for the purchase of the ordered items between the buyer and the provider is irrevocably concluded.
4. Proforma invoice and payment: at this stage the provider issues the final proforma invoice. If the consumer has chosen payment on delivery of the goods, the provider will wait with further dispatch of the goods until it receives confirmation of payment of the issued proforma invoice. The deadline for payment of the proforma invoice is 3 working days. In other cases, payment of the order applies on collection.
5. Collection or delivery of goods: within the agreed period the provider prepares, delivers or dispatches the goods and notifies the buyer by email or telephone. The conditions stated below apply to returns or exchanges of goods.

Plačilo s Flik aplikacijo je na voljo le registriranim uporabnikom spletne trgovine. Delivery and collection of the order:
Information about the supply and delivery time of the goods is shown for each product and depends on warehouse stock, which is updated daily. If there is a change in supply at the time of ordering, PAKETKO d.o.o. will notify the buyer by telephone or email.
Podjetje PAKETKO d.o.o. in partnerji zapakira in odpošlje blago in morebitnimi navodili če jih je proizvajelec priložil. Dostava blaga je mogoča samo v Republiki Sloveniji in Hrvaški.
The provider will deliver the goods or service within the agreed period, except in cases of force majeure when delivery is hindered (floods, ice storms, etc.).
The contractual partner for delivery of shipments is DPD. On delivery the courier contacts you on the telephone number you provided when placing the order, informs you about the arriving parcel and delivers it to the address you specified when ordering.
Additional shipping costs may arise for the user if the user wishes to return goods and sends them "cash on delivery". We do not accept such shipments, as the company is unable to determine the fault in the product itself, and in such a case the consumer will have the shipment returned, for which a certain amount is charged (depending on the weight of the shipment) by DPD.
Delivery cost:
- delivery over EUR 100 is free
- delivery up to EUR 100 costs EUR 5.00
Returns and exchanges of goods:
Potrošnik ima pravico, da v 14 dneh podjetju sporoči, da odstopa od pogodbe, ne da bi mu bilo treba navesti razlog za svojo odločitev. Edini strošek, ki bremeni potrošnika v zvezi z odstopom od pogodbe, je neposreden strošek vračila blaga. O nameravanem vračilu mora potrošnik pisno obvestiti ponudnika najkasneje v 14 dneh od prejetja blaga, in sicer na kontaktni e-naslov info@termoplast.si, blago pa vrniti v nadaljnjih 14 dneh.
V primeru odstopa iz pogodbe PAKETKO d.o.o. oziroma najpozneje v 14 dneh po prejemu obvestila o odstopu od pogodbe vrne vsa prejeta plačila.
PAKETKO d.o.o. refunds the payments received to the consumer using the same means of payment used by the consumer, unless the consumer expressly requested the use of another means of payment and provided the consumer bears no costs as a result. In sales contracts, PAKETKO d.o.o. may withhold the refund of payments received until the returned goods are collected or until the consumer provides proof that the goods have been sent back, unless the company offers to collect the returned goods itself.
If the consumer has already received the goods and withdraws from the contract, they return or hand over the goods to the company or a person authorised by the company to collect the goods, immediately or no later than 14 days after the notice referred to in the first paragraph of Article 43 of this Act, unless the company offers to collect the returned goods itself. The consumer is deemed to return the goods in time if they send them before the expiry of the 14-day return period.
Returns for legal entities:
If you want an invoice issued to a company, you accept the terms and conditions that apply to companies. We allow companies, sole traders and other legal entities to return shipments of items within the warranty conditions. Legal entities do not have the option to withdraw from the contract within 14 days or to receive a refund as applies to consumers (natural persons).
Return of damaged shipments:
If the parcel is physically damaged, contents are missing or it shows signs of having been opened, the consumer must initiate a complaint procedure with DPD or the courier that delivered the parcel. You do this by calling DPD (without adding or removing anything) and completing a complaint report. Together with DPD we will ensure that the complaint is resolved as quickly as possible.

Zaradi narave poslovanja preko svetovnega spleta se ponudba spletne trgovine termoplast.si ažurira in spreminja pogosto in hitro. Ponudnik se po svojih najboljših močeh trudi zagotoviti ažurnost in pravilnost podatkov, ki so objavljeni na njegovih straneh. Kljub temu pa se lahko lastnosti artiklov, rok dobave ali cena spremenijo tako hitro, da ponudnik ne uspe popraviti podatkov na spletnih straneh. V takem primeru bo ponudnik kupca obvestil o spremembah in mu omogočil odstop od naročila ali zamenjavo naročenega artikla.
Warranty:
Items have a warranty if so stated on the warranty card or on the invoice. The warranty is valid subject to following the instructions on the warranty card and on presentation of the invoice. Warranty periods are stated on the warranty cards or on the invoice.
Informacija o garanciji je navedena tudi na strani s predstavitvijo artikla. Če informacije o garanciji ni, artikel nima garancije ali pa podatek v tem trenutku ni znan. V slednjem primeru lahko potrošnik kontaktira PAKETKO d.o.o., ki bo zagotovil ažurno informacijo. Za naročila preko telefona veljajo enaki pogoji.

Defects of goods:
The consumer may exercise their rights regarding a defect of goods if they notify the seller of the defect within two months from the day the defect was discovered. In the notice of defect the consumer must describe the defect precisely and allow the seller to examine the item.
The consumer may communicate the notice of defect to the seller in person, for which the seller must issue a confirmation, or send it to our address where the item was purchased, or to the seller's representative with whom the contract was concluded.
PAKETKO d.o.o. is not liable for defects of goods that appear after two years have passed since the item was handed over. A defect is deemed to have existed at the time of delivery if it appears within six months of delivery. The consumer's rights under the first paragraph expire two years from the day they notified the seller of the defect.
A consumer who has duly notified the seller of the defect has the right to require the seller to:
- remedy the defect in the goods
- refund part of the amount paid in proportion to the defect
- replace the defective goods with new flawless goods
- refund the purchase price
Če obstoj napake na blagu oziroma nepravilnost pri opravljeni storitvi ni sporna, mora podjetje čimprej, vendar najpozneje v roku osmih dni ugoditi potrošnikovi zahtevi iz 37.c in 38. člena tega zakona.
PAKETKO d.o.o. must respond to the consumer's request in writing no later than eight days after receiving it, if the existence of a defect in the goods or an irregularity in the service performed is disputed.
Legal protection:
For other conditions not stated in these terms and conditions, the provisions of the applicable relevant legislation apply.

Data storage and protection:
Prodajalec skladno z zakonom shranjuje vse pogodbe sklenejene na daljavo na svojem elektronskem naslovu, prav tako pa ima varnostno kopijo za le-te v svojem arhivu. V kolikor naročnik želi vpogled v sklenjeno pogodbo, lahko poda prošnjo za to preko elektronske pošte na info@termoplast.si. Ponudnik se zavezuje da bo poslal pogodbe v roku 8 delovnih dni.
The provider undertakes to permanently protect all of the user's personal data. The provider will use personal data solely for the purpose of fulfilling the order (sending informative materials, offers, invoices) and other necessary communication. The user's data will under no circumstances be handed over to unauthorised persons. The user is also responsible for protecting their personal data by ensuring the security of their username and password.
Legal notice:
Vsebine, objavljene na spletnih straneh termoplast.si, so last podjetja PAKETKO d.o.o.in dobaviteljev in se lahko uporabljajo le v nekomercialne namene, kjer pa morajo ohraniti vsa navedena opozorila o avtorskih pravicah in se torej ne smejo prepisovati, razmnoževati ali kako drugače razširjati. Complaints and disputes:
PAKETKO d.o.o. respects the applicable European consumer protection legislation. PAKETKO d.o.o. makes every effort to fulfil its duty to establish an effective system for handling complaints and to designate a person whom the consumer can contact by telephone or email in the event of problems.
A complaint is submitted via the email address info@termoplast.si. The complaint handling procedure is confidential. PAKETKO d.o.o. will, within five working days, confirm receipt of the complaint, inform the buyer how long it will take to handle it and keep them informed throughout the procedure.
Termoplast se zaveda, da je bistvena značilnost potrošniškega spora, vsaj kar zadeva sodno reševanje, njegova nesorazmernost med ekonomsko vrednostjo zahtevka in stroški, ki nastanejo pri reševanju samega spora. To je tudi glavna ovira, da potrošnik ne sproži spora pred sodiščem. Zato si PAKETKO d.o.o. prizadeva po svojih najboljših močeh, da se morebitni spori rešijo sporazumno. Pritožbo je potrebno pisno poslati na sedež podjetja (PAKETKO d.o.o., Prečna pot 6, 8257 Dobova). In the case of judicial dispute resolution, the competent court is the one for the consumer's permanent residence.
Out-of-court resolution of consumer disputes:
In accordance with statutory provisions, we do not recognise any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer could initiate under the Out-of-Court Consumer Dispute Resolution Act. Termoplast, which as a provider of goods and services operates an online store in Slovenia, publishes on its website an electronic link to the online consumer dispute resolution platform (ODR). The platform is available to consumers at the link HERE.
The above arrangement derives from the Out-of-Court Consumer Dispute Resolution Act, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online consumer dispute resolution and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.
